False or misleading information or documents

Providing false or misleading information or documents with a visa application can have serious consequences. Beyond the application being refused, you may be subject to a 3 year ban on applying for any Australian visas.

The Department of Home Affairs does not refuse applications on this basis due to innocent information errors that do not lead to the Department making a decision they otherwise wouldn’t have, such as getting an employment commencement date wrong by a day. It is information that is given in an attempt to achieve a visa outcome the applicant would otherwise not be entitled to that the Department is concerned about.

Bogus documents (fake documents) can come in many forms. These include:

  • Documents presented as belonging to the applicant but were actually issued to someone else

  • Counterfeit documents or documents altered by a person who does not have authority to do so

  • Documents obtained because of false or misleading statements, whether or not made knowingly

If you are concerned there might be risk associated with your application, the best approach is to explain the issue to the Department in full (if the information is required to be disclosed) and explain to the Department why this should not prevent visa grant. We can help you with this.
