Visa Condition Waivers

Most temporary visas come with conditions. The type of condition on the visa is determined either by the type of visa, as well as the Department’s discretion when deciding the grant a visa. For example, some tourist visa holders may have a ‘no further stay’ condition on their visa, while others do not.

Visa holders may need to request a condition on their visa be waived for a variety of reasons. In the case of a tourist visa holder unable to apply for a further visa in Australia, perhaps there has been a change of circumstances since arrival in Australia, and the holder wants to submit a new visa application within Australia, like a partner visa.

Another common scenario is a no work condition on a Bridging Visa C, where the visa holder needs to work. If the visa holder is in financial hardship, an application can be made to waive this condition.
