Administrative Review Tribunal

Visa applicants who have had a visa application refused may be able to apply to the Administrative Review Tribunal (‘ART’) to have the decision reviewed. The ART acts as an independent decision maker to ensure the original decision made by the Department of Home Affairs (‘DHA’) was correct. Applicants can provide the ART with new documents and information to help bolster their case. The ART will then assess the application, taking into consideration all information provided, and make a decision as if the application was being assessed for the first time.

Not all visa refusal decisions can be reviewed by the ART. Types of applications most commonly reviewed are:

  • A decision to refuse an application that was lodged onshore

  • A decision to cancel a visa

  • A decision not to revoke visa cancellation

  • A decision to refuse a visa that required sponsorship or nomination
